Article 2 – Definitions
In these terms and conditions, the following terms have the meanings set out below:
Supplementary agreement: an agreement under which a consumer acquires products in connection with a distance contract, where those products are supplied by Sea Me Happy or by a third party on the basis of an arrangement between that third party and Sea Me Happy;
Withdrawal period: the period within which a consumer can exercise their right of withdrawal;
Consumer: the natural person who is not acting for purposes related to their trade, business, craft, or profession;
Day: calendar day;
Durable medium: any tool — including e-mail — that enables a consumer or Sea Me Happy to store information addressed to them personally in a way that allows future reference or use for a period appropriate to the purpose of the information, and that allows unaltered reproduction of the stored information;
Right of withdrawal: the option for a consumer to withdraw from the distance contract within the withdrawal period;
Distance contract: an agreement concluded between Sea Me Happy and a consumer under an organized system for the distance selling of products, where, up to and including the conclusion of the agreement, exclusive or partial use is made of one or more means of distance communication;
Withdrawal form: the withdrawal form included in Appendix I of these terms;
Means of distance communication: any means that can be used to conclude an agreement without the consumer and Sea Me Happy needing to be present in the same place at the same time.
Article 3 – Applicability
These terms and conditions apply to every offer made by Sea Me Happy and to every distance contract concluded between Sea Me Happy and a consumer.
Before the distance contract is concluded, the text of these terms and conditions is made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable medium. If this is not reasonably possible, Sea Me Happy will indicate, before the distance contract is concluded, how the terms and conditions can be reviewed electronically, and that they will be sent free of charge, electronically or otherwise, at the consumer’s request.
Article 4 – The Offer
If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.
Obvious mistakes or errors in the offer of products are not binding on Sea Me Happy.
Every offer contains information that makes clear to the consumer what rights and obligations are attached to acceptance of the offer.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and satisfies the conditions set therein.
If the consumer has accepted the offer electronically, Sea Me Happy will promptly confirm electronic receipt of the acceptance of the offer.
Sea Me Happy will provide the consumer, no later than at delivery of the product, with the following information:
the visiting address of Sea Me Happy’s place of business where the consumer can, for example, file complaints;
the conditions under which, and the manner in which, the consumer can exercise the right of withdrawal, or a clear notice regarding the exclusion of the right of withdrawal;
information about guarantees and existing after-sales service;
the price, including all taxes, of the product, and where applicable the costs of delivery, and the method of payment, delivery, or performance of the distance contract;
the withdrawal form, if the consumer has a right of withdrawal.
Article 6 – Right of Withdrawal
The consumer may dissolve an agreement relating to the purchase of a product within a withdrawal period of 14 days, without giving any reason. Sea Me Happy may ask the consumer for the reason for withdrawal, but the consumer is not obliged to state their reason(s).
The withdrawal period referred to in paragraph 1 begins on the day after the consumer, or a third party designated in advance by the consumer who is not the carrier, has received the product, or:
if the consumer has ordered multiple products in the same order: the day on which the consumer, or a third party designated by them, received the last product. Sea Me Happy may, provided it has clearly informed the consumer of this before the ordering process, refuse an order for multiple products with different delivery times; or
if delivery of a product consists of several shipments or parts: the day on which the consumer, or a third party designated by them, received the last shipment or the last part.
Withdrawal button (online withdrawal function)
Since 19 June 2026, new obligations apply, under EU Directive 2023/2673, to businesses that conclude distance contracts through an online interface. Sea Me Happy therefore provides a clearly visible and easily accessible online withdrawal function (the “withdrawal button”) on the website, allowing the consumer to exercise their right of withdrawal in a single action throughout the entire withdrawal period. This function is in addition to, and does not replace, the option to withdraw via the withdrawal form, e-mail, or any other unambiguous statement to Sea Me Happy.

Artikel 2 – Definities
Aanvullende overeenkomst: een overeenkomst waarbij een consument producten verwerft in verband met een overeenkomst op afstand en deze producten door Sea Me Happy worden geleverd of door een derde partij op basis van een afspraak tussen die derde en Sea Me Happy;
Bedenktijd: de termijn waarbinnen een consument gebruik kan maken van zijn herroepingsrecht;
Consument: de natuurlijke persoon die niet handelt voor doeleinden die verband houden met zijn handels-, bedrijfs-, ambachts- of beroepsactiviteit;
Dag: kalenderdag;
Duurzame gegevensdrager: elk hulpmiddel – waaronder ook begrepen e-mail – dat een consument of Sea Me Happy in staat stelt om informatie die aan hem persoonlijk is gericht, op te slaan op een manier die toekomstige raadpleging of gebruik gedurende een periode die is afgestemd op het doel waarvoor de informatie is bestemd, en die ongewijzigde reproductie van de opgeslagen informatie mogelijk maakt;
Herroepingsrecht: de mogelijkheid voor een consument om binnen de bedenktijd af te zien van de overeenkomst op afstand;
Overeenkomst op afstand: een overeenkomst die tussen Sea Me Happy en een consument wordt gesloten in het kader van een georganiseerd systeem voor verkoop op afstand van producten, waarbij tot en met het sluiten van de overeenkomst uitsluitend of mede gebruik gemaakt wordt van één of meer technieken voor communicatie op afstand;
Herroepingsformulier: het in Bijlage I van deze voorwaarden opgenomen formulier voor herroeping;
Techniek voor communicatie op afstand: middel dat kan worden gebruikt voor het sluiten van een overeenkomst, zonder dat een consument en Sea Me Happy gelijktijdig in dezelfde ruimte hoeven te zijn samengekomen.
Artikel 3 – Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op elk aanbod van Sea Me Happy en op elke tot stand gekomen overeenkomst op afstand tussen Sea Me Happy en een consument.
Voordat de overeenkomst op afstand wordt gesloten, wordt de tekst van deze algemene voorwaarden langs elektronische weg aan de consument beschikbaar gesteld op zodanige wijze dat deze door de consument op een eenvoudige manier kan worden opgeslagen op een duurzame gegevensdrager. Indien dit redelijkerwijs niet mogelijk is, zal Sea Me Happy voordat de overeenkomst op afstand wordt gesloten, aangeven op welke wijze van de algemene voorwaarden langs elektronische weg kan worden kennisgenomen en dat zij op verzoek van de consument langs elektronische weg of op andere wijze kosteloos worden toegezonden.
Artikel 4 – Het Aanbod
Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.
Kennelijke vergissingen of kennelijke fouten in het aanbod van producten binden Sea Me Happy niet.
Elk aanbod bevat zodanige informatie dat voor de consument duidelijk is wat de rechten en verplichtingen zijn, die aan de aanvaarding van het aanbod zijn verbonden.
Artikel 5 – De Overeenkomst
De overeenkomst komt tot stand op het moment van aanvaarding door de consument van het aanbod en het voldoen aan de daarbij gestelde voorwaarden.
Indien de consument het aanbod langs elektronische weg heeft aanvaard, bevestigt Sea Me Happy onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod.
Sea Me Happy zal uiterlijk bij levering van het product aan de consument de volgende informatie verschaffen:
het bezoekadres van de vestiging van Sea Me Happy waar de consument bijvoorbeeld met klachten terecht kan;
de voorwaarden waaronder en de wijze waarop de consument van het herroepingsrecht gebruik kan maken, dan wel een duidelijke melding inzake het uitgesloten zijn van het herroepingsrecht;
de informatie over garanties en bestaande service na aankoop;
de prijs met inbegrip van alle belastingen van het product, voor zover van toepassing de kosten van aflevering en de wijze van betaling, aflevering of uitvoering van de overeenkomst op afstand;
indien de consument een herroepingsrecht heeft, het herroepingsformulier.
Artikel 6 – Herroepingsrecht
De consument kan een overeenkomst met betrekking tot de aankoop van een product gedurende een bedenktijd van 14 dagen zonder opgave van reden ontbinden. Sea Me Happy mag de consument vragen naar de reden van herroeping, maar de consument is niet verplicht tot opgave van zijn reden(en).
De in lid 1 genoemde bedenktijd gaat in op de dag nadat de consument, of een vooraf door de consument aangewezen derde, die niet de vervoerder is, het product heeft ontvangen, of:
als de consument in eenzelfde bestelling meerdere producten heeft besteld: de dag waarop de consument, of een door hem aangewezen derde, het laatste product heeft ontvangen. Sea Me Happy mag, mits hij de consument hier voorafgaand aan het bestelproces op duidelijke wijze over heeft geïnformeerd, een bestelling van meerdere producten met een verschillende levertijd weigeren; of
als de levering van een product bestaat uit verschillende zendingen of onderdelen: de dag waarop de consument, of een door hem aangewezen derde, de laatste zending of het laatste onderdeel heeft ontvangen.
Herroepingsknop (online herroepingsfunctie)
Sinds 19 juni 2026 gelden er, op grond van EU-Richtlijn 2023/2673, nieuwe verplichtingen voor ondernemingen die overeenkomsten op afstand sluiten via een online interface. Sea Me Happy voorziet daarom een duidelijk zichtbare en eenvoudig toegankelijke online herroepingsfunctie (“herroepingsknop”) op de website, waarmee de consument zijn herroepingsrecht met één handeling kan uitoefenen gedurende de volledige bedenktijd. Deze functie is een aanvulling op, en vervangt niet, de mogelijkheid om te herroepen via het herroepingsformulier, e-mail, of een andere ondubbelzinnige verklaring aan Sea Me Happy.
